Buyer's Terms & Conditions CONDITIONS OF BUSINESS
Conditions mainly concerning Buyers
- The highest bidder will be the buyer at the “hammer price” and any dispute will be settled at the auctioneers absolute discretion. Every bidder will be deemed to act as principal unless there is in force a written acknowledgement by Ashbey’s Galleries CC that he/she acts as agent on behalf of the named principal.
- Ashbey’s Galleries CC shall have full discretion to refuse any bid, to divide any lot, to combine any two or more lots and to withdraw any lot or lots from sale without giving any reason.
- All lots are sold as shown with all faults, imperfections and errors of any description: neither Ashbey’s Galleries CC nor the seller being in any way responsible for the genuiness, authenticity, errors of description of any lots, or any fault or defect however caused. No warranty whatever is given by Ashbey’s Galleries CC, or any seller to any buyer in respect of any lot and any implied conditions or warranties are hereby excluded. Care is taken to ensure that any statement as to origin, date, age , attribution and condition is reliable and accurate but all such statements are statements of opinion are not be taken as representation of fact. The absence of any reference to the conditions of lots does not imply that the lot is free from imperfections. A bid shall be taken as proof that the Buyer had made him/herself fully acquainted with the lots for which he/she bids.
- Immediately the lot is sold, the buyer shall notify Ashbey’s Galleries CC of his/her name and permanent address an if required: (a) provide bank or other references or (b) to pay down 50c in the Rand in part payment of the aggregate price, in default of which the lot may be put up immediately and resold. All accounts are payable on the day of the sale and if not paid on that day are liable to a charge of 10% for collection. All purchases must be collected from the Auction Premises within 24 house form the end of sale. Any lot not collected within the period advised will be stored an the purchaser’s expense at the rate of R50 per day per lot plus VAT.
- Ashbey’s Galleries CC may not be held responsible for any lot once sold. Responsibility transfers immediately to the purchase upon the hammer. Any lots left at Ashbey’s Galleries CC do so at the risk of the purchaser.
- The Auctioneer’s Vendu Roll is final and no dispute will be taken into consideration as to the correctness of some.
- The estimates shown in the Catalogue are Ashbey’s Galleries CC considered opinion and are provided purely as a guide to prospective purchasers. They have no bearing or relation to reserve prices, (if any).
- The Buyer shall pay a 16% Buyers Premium inclusive of VAT, on the hammer price. This charge will be shown on the purchasers invoice. Terms: Cash or bank and personal bank guaranteed cheques are accepted. Please note: we only accept VISA or MASTERCARD credit cards.
